By accessing the TiyanPie mobile application, you (referred to as “User,” “Member,” or “You”) agree to be bound by these Terms of Use (referred to as “Agreement”) and the Company’s Privacy Policy, which can be found under “Privacy.” If you wish to use TiyanPie or become a Member and utilize the TiyanPie service (referred to as the “Service”), please carefully read this Agreement. Acceptance of these Terms of Use is a requirement for using the Application. The Terms of Use are written in English, and it is advised not to rely on any non-English translations. In case of any discrepancies or inconsistencies, refer to the English Terms.
IF YOU DO NOT ACCEPT AND AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT, OR IF YOU DO NOT MEET OR COMPLY WITH ITS PROVISIONS, PLEASE DO NOT USE THE APP OR THE SERVICE.
The Service comprises the following aspects:
(a) Offering personalized opportunities to connect, hang out, and create social media at popular bucket-list destinations. Our aim is to enhance your social media partnerships through shared experiences that hold true significance for you. To achieve this, we have developed an application that strives to understand your interests and those of others. We utilize this information to assist you in creating, finding, and joining social media creation projects as a sponsor or content creator at popular experience destinations. This includes highlighting content, features, offers, and accounts that align with your interests, both on and off TiyanPie.
(b) Fostering a positive, inclusive, and safe environment. We are dedicated to cultivating a positive and inclusive environment for our community members. To support this, we develop tools and provide resources to ensure their experiences are enjoyable and inclusive. In cases where we identify a need for assistance, we offer support. Additionally, we have teams and systems in place to address abuse, violations of our terms and policies, as well as harmful and deceptive behavior. We leverage all available information, including your data, to maintain the security of our platform. In certain instances, we may also share information about misuse or harmful content with other companies or law enforcement agencies. For more details, please refer to our Data Policy.
(c) Connecting you with brands, products, and services that align with your interests. We utilize data from Verve Group and our third-party partners to display ads, offers, and other sponsored content that we believe will be relevant and meaningful to you. Our aim is to ensure that this content is as relevant to you as all your other experiences on TiyanPie.
(d) Research and innovation. We utilize the available information to conduct research on our Service and collaborate with others to improve it and contribute to the well-being of our community.
(e) Paid Services. Certain features, such as creating and joining 10 project requests, showing VIP badges, and having the ability to receive commission payments from Canadian experience destinations, are paid services. We may introduce additional paid services in the future and will update the list accordingly.
(f) Canadian VIP Subscribers and Commission Payments: As a special offering for Canadian subscribers who have subscribed to the paid VIP service, we provide an additional benefit. These subscribers have the opportunity to receive commissions by joining experience projects located in Canada as influencers or social media content creators. The commission rate is set at 1.8% of the actual spending before tax for the specific experience project. Commissions are payable on the 15th of each month, provided that the subscriber has accumulated at least $200 Canadian dollars in commissions. This initiative aims to reward Canadian VIP subscribers for their participation and contribution to the TiyanPie community.
(a) We strive to make our Service open and inclusive, while prioritizing safety, security, and adherence to the law. Therefore, we kindly ask you to comply with certain restrictions to be a part of the TiyanPie community.
(b) You must be at least 18 years old or meet the minimum legal age requirement in your country to use TiyanPie.
(c) You must not be prohibited from receiving any aspect of our Service under applicable laws or engaging in payment-related services if you are listed on any applicable denied party listings.
(d) Your account must not have been previously disabled by us due to violations of the law or any of our policies.
(e) You must not be a convicted sex offender.
(f) To access the Paid Services, you are required to subscribe to the VIP membership. Before acquiring paid services, you must agree to both our Paid Service Contract and this agreement.
Providing a safe and open Service for a diverse community requires that we all contribute to maintaining these standards.
(a) Impersonating others or providing inaccurate information is strictly prohibited.
(b) While disclosing your identity on TiyanPie is not mandatory, it is essential to provide us with accurate and up-to-date information during registration. Furthermore, you may not impersonate another individual, and creating an account for someone else is only permissible with their explicit permission.
(c) Engaging in unlawful, misleading, fraudulent, or unauthorized activities on TiyanPie is strictly prohibited.
(d) Violating, assisting, or encouraging others to violate these Terms or our policies, including the TiyanPie Community Guidelines, is strictly prohibited.
(e) Any actions that interfere with or impair the intended operation of the Service are not allowed.
(f) Unauthorized attempts to create accounts, access, or collect information are strictly prohibited. This includes automated account creation or information collection without our explicit permission.
(g) Any attempts to buy, sell, or transfer any aspect of your account (including your username) or solicit, collect, or use login credentials or badges of other users are strictly prohibited.
(h) Posting private or confidential information or engaging in activities that infringe upon someone else’s rights, including intellectual property rights, is strictly prohibited.
(i) Using a domain name or URL in your username without our prior written consent is not allowed.
As part of our agreement, you provide us with permissions that are necessary for us to provide the Service.
(a) We do not claim ownership of the content you share, but you grant us a license to use it. Your rights in your content remain unchanged. We do not claim ownership of the content you post on or through the Service. However, when you share, post, or upload videos that are protected by intellectual property rights on or in connection with our Service, you hereby grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content. You have the option to end this license at any time by deleting your content or account. However, if you have shared your content with others and they have not deleted it, it may continue to appear.
(b) Permission to use your username, profile picture, and information about your interactions and relationships with accounts, ads, and sponsored content. By using the Service, you grant us permission to display your username, profile picture, and information about your actions (such as likes) or relationships (such as follows) in connection with accounts, ads, offers, and other sponsored content that you engage with on TiyanPie, without any compensation to you. For example, we may show that you liked a sponsored post created by a brand that has paid us to display its ads on TiyanPie, Volckano.com, and Verve Group Inc. Similar to actions on other content and follows of other accounts, actions on sponsored content and follows of sponsored accounts can only be seen by people who have permission to view that content or follow.
(c) You agree to allow us to download and install updates to the Service on your device.
(d) If you choose a username or a similar identifier for your account, we may change it if we believe it is necessary or appropriate (for instance, if it infringes someone’s intellectual property rights or impersonates another user).
(e) If you utilize content that is protected by intellectual property rights and made available by us in our Service (such as text, images, designs, videos, or sounds that we provide for you to include in your own content), we retain all rights to our content, but not to yours.
(f) You may only use our intellectual property and trademarks, or similar marks, with our explicit prior written permission.
(g) If you intend to modify, create derivative works of, decompile, or attempt to extract source code from our Service, you must obtain written permission from us.
We have the authority to remove any content or information you share on the Service if we believe it violates these Terms of Use, our policies (including our Community Guidelines), or if we are permitted or required to do so by law. Furthermore, we reserve the right to refuse or discontinue providing all or part of the Service to you, including disabling or terminating your account, immediately, if it is necessary to protect our community or services, if you pose a risk or legal exposure to us, if you violate these Terms of Use or our policies (including our Community Guidelines), if you repeatedly infringe on other people’s intellectual property rights, or if we are permitted or required to do so by law. We will notify you appropriately if we take any action to disable or terminate your account. If you believe that your account has been terminated in error, or if you wish to disable or permanently delete your account, please contact us. Our contact information can be found at the end of the Terms.
Content you delete may persist for a limited period of time in backup copies and may still be visible if others have shared it. This paragraph, along with the section below titled “Our Agreement and What Happens if We Disagree”, will remain applicable even after your account is terminated or deleted.
(a) Any amendment or waiver to our agreement must be in writing and signed by both parties. Our failure to enforce any aspect of this agreement will not be considered a waiver.
(b) We retain all rights not expressly granted to you.
(a) This agreement does not confer rights to any third parties.
(b) You cannot transfer your rights or obligations under this agreement without our consent.
(c) We have the right to assign our rights and obligations to others. This may occur in the event of a change in ownership, such as a merger, acquisition, or sale of assets, or as required by law.
(a) Our Service is provided “as is,” and we cannot guarantee that it will always be safe, secure, or function perfectly. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
(b) We do not exercise control over the actions, conduct, or content of individuals or entities, and we are not responsible for their (or your) actions or conduct, whether online or offline, or for any content, including unlawful or objectionable content. We are also not responsible for services and features offered by third parties, even if you access them through our Service.
(c) Our liability for any issues arising from the use of our Service (referred to as “liability”) is limited to the maximum extent permitted by applicable law. We cannot anticipate all possible impacts or consequences of using our Service. You agree that we will not be liable for any lost profits, revenues, information, or data, or for any consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these Terms, even if we are aware of the possibility of such damages. This includes cases where we delete your content, information, or account.
If you are a consumer, the laws of the country in which you reside will govern any claim, cause of action, or dispute you have against us arising out of or relating to these Terms (“claim”). You may resolve your claim in any competent court in that country that has jurisdiction over the claim. In all other cases, you agree that any claim must be exclusively resolved in the Ontario Court located in Mississauga, Ontario, and you consent to the personal jurisdiction of either of these courts for the purpose of litigating any such claim. The laws of the Ontario Court will govern these Terms and any claim, without regard to conflict of law provisions.
We always appreciate feedback and other suggestions, but we may use them without any restrictions or obligation to compensate you, and we are under no obligation to keep them confidential.
We may modify our Service and policies, and we may need to make changes to these Terms in order to accurately reflect our Service and policies. Unless otherwise required by law, we will notify you (for example, through our Service) before implementing changes to these Terms and give you an opportunity to review them before they take effect. If you continue to use the Service after the changes are made, you will be bound by the updated Terms. If you do not agree to these or any updated Terms, you may delete your account by accessing the Settings Page in the app.
